Larchmont Couple Pleads Guilty to Tax Evasion

Christopher and Denise MacDonald of Larchmont have plead guilty to Grand Larceny and Repeated Failure to File Tax Returns.

The couple own three local businesses which were also charged.

A 12 month investigation conducted by Westchester County District Attorney Janet DiFiore and New York State Department of Taxation and Finance led to the guilty pleas, DiFiore’s office announced Friday.

Denise MacDonald, 48, plead guilty to one count of Repeated Failure to File Personal Tax Returns, a class “E” Felony.  Christopher MacDonald, 54, plead guilty to one count of Repeated Failure to File Personal Tax Returns, a class “E” Felony, said the District Attorney’s spokesman.

In addition C.W.M. Horticultural Services, Inc., a landscaping company, of 1943 Palmer Avenue, Larchmont, New York plead guilty to one count of Grand Larceny in the Second Degree, a class “C” Felony.

Twinkle Toes Baby, Inc., a baby clothing store with two stores, one in Rye and the other at 1943 Palmer Avenue, Larchmont, New York plead guilty to one count of Grand Larceny in the Second Degree, a class “C” Felony,

Wish Home Styles, Inc., a home furnishings store in Rye with plead guilty to one count of Grand Larceny in the Third Degree, a class “D” Felony.

Over a period of eleven years, from 1998 through to 2009 the defendants who owned and operated the three businesses, collected New York State sales tax and failed to remit the money to New York State, according to investigators.

The defendants also allegedly failed to pay personal income tax to New York State.

Along with their guilty pleas today, the two individuals and three businesses have agreed to pay New York State $542,066.00 of unpaid New York State sales tax.

Sentencing will be June 14th.
